Seems that way. It is a wonder the government did not fine the maufacturer of the truck and trailer as well. As if the truck and trailer had not been built, then they would not have been able to overload it.

But of course if the driver did something stupid and got injured, the law would say it would not be the drivers fault in any way but the business owners fault. And people wonder why businesses move off shore and import.

I couldn't agree more. The only bloke to get in the sh#t is the bloke who wasn't there. As for the driver, he must be a moron if he legitimately didn't know he was 10 T. over.

There was a case some years back some driver decided to drive up the highway with his tipper tray still up. He was going well until a bridge slowed him down somewhat.

Government did not go after the driver but rather the company that owned the truck. They said the company should have had installed some very expensive piece of hardware that locks the truck out of any gear but first should the tray be up.

The first rule of "revenue raising" is to prosecute someone with assets or insurance cover.No profit in a broke truckdriver.Bet the council never paid a penny,that would be counterproductive.
