a group of Australians took the transport issue Btwen states to the hi court in London n won
they were pushing for free trade btween states n th@'z how interstate raod transport began in Australia
the States @ the time were try n to push an antiquated Rail transport system
But we still dont have a Fwy Btween capital cities

Australia is a federation that relies on the constitution to divide power between the federal government, states and territories. As the Commonwealth of Australia Constitution Act did not specify powers of control over road transport it effectively relinquished full jurisdiction of such reforms to the states and territories.
In 1952, truck drivers were frustrated by the levies on interstate road transport, which were designed to protect the state-owned railways. They placed a copy of the constitution in a barrow and pushed it by hand between Melbourne and Sydney. This journey took 11 days, 2 days quicker than a parcel mailed at the same time and carried by rail.
Their purpose was to challenge the validity of the New South Wales State Transport Act against

Hughes and vales court case 1954.
The legislationwas upheld in the high court
but was declared invalid on appeal to the privy council
Legislation in all other states was declared invalid
The NSW government ammended the legislation
but it too was declared invalid..............
